The debt collection industry is governed by stringent guidelines which NCML is proud to abide by and, in some cases, has helped to shape. We are acutely aware of the impact of increased regulation and the subsequent challenges facing the sectors in which we operate.

Compliance is at the heart of everything we do. We make sure it's built into all of our processes and we adhere to all relevant regulations to protect our clients and others who deal with us.

  • WA - Debt Collector's Licence (Debt Collectors Licencing Act 1964)

Legislation

The conduct of debt collectors towards debtors (people obligated or allegedly obligated to pay a debt) is covered by provisions in a number of consumer protection laws including:

  • Fair Trading Act 2010 (administered by Consumer Protection)
  • National Credit Code (administered by ASIC)
  • Privacy Act 1988 (Commonwealth legislation)
  • Competition and Consumer Act 2010 (previously the Trade Practices Act 1974, administered by the ACCC)
  • Australian Securities and Investments Commission Act 2001 (administered by ASIC)

Our compliance framework also extends to broader legislative requirements including the Telecommunications Act regarding call attempt frequency, Payment Card Industry Data Security Standard (PCI DSS), Anti Money Laundering and Counter Terrorism Legislation.

Of these, we have invested considerable resources in achieving PCI DSS compliance, which sets us apart in the market. This is aligned to our commitment to deliver a secure data management framework to clients, and to be the industry's most trusted and compliant provider of debt recovery services.

As testament to our compliance systems, in 23 years of providing debt collection and recovery services, NCML has never had a compliance breach escalate beyond internal processes.

Our Quality Management System holds current certification to Australian Standard ISO 9001:2015. In 2011, we received an SAI Global Systems Excellence Award in recognition of 15 years' continuous certification for our Quality Management Systems.

This International Standard accreditation acknowledges our ability to consistently obtain high customer satisfaction while complying with all applicable statutory requirements, within a framework that promotes continuous improvement.

Industry Affiliations

NCML works closely with trade associations, government bodies and consumer groups to improve standards in the industry and to build customer confidence in what we do.

We have been a member of the Australian Institute of Credit Management (AICM), the Association of Credit and Collection Professionals (ACA) and the Institute of Mercantile Agents (IMA) for over 20 years.
